2. Description of Service

VisualStory AI is a software platform for creative writing and story creation. The Service provides tools for writing stories, creating storyboards, and generating illustrative content for fictional narratives. The Service is designed exclusively for creating fictional stories and creative content. The Service includes both free and paid subscription tiers.

3. Free Tier

Users may create up to 5 stories for free without providing payment information. The free tier includes all core features with story creation limits. Free tier users retain full access to their created content.

4. Subscription Plans

4.1 Pro Plan

The Pro Plan is a paid subscription that provides unlimited story creation and access to premium features. Subscription plans are available on a monthly or annual basis.

4.2 Billing

Subscriptions are billed in advance on a recurring basis. Monthly subscriptions are billed monthly, and annual subscriptions are billed annually. All payments are processed securely through Paddle, our payment processor.

4.3 Price Changes

We reserve the right to modify subscription prices at any time. Price changes will be communicated to existing subscribers at least 30 days in advance. Continued use of the Service after a price change constitutes acceptance of the new pricing.

5. Payment Terms

Payments are processed by Paddle, a third-party payment processor. By subscribing, you agree to Paddle's terms and conditions. We do not store your payment information directly.

All prices are displayed in your local currency where available. Currency conversion rates are determined by Paddle and may vary.

6. Cancellation and Refunds

6.1 Cancellation

You may cancel your subscription at any time through your account settings or by contacting customer support. Cancellation will take effect at the end of your current billing period. You will continue to have access to Pro features until the end of the paid period.

6.2 Refunds

Refunds are available within 14 days of the initial subscription purchase, provided you have not exceeded reasonable usage limits. Refund requests must be submitted through customer support. Refunds for annual subscriptions may be prorated based on usage.

7. User Content

You retain all rights to content you create using the Service. By using the Service, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service.

You are responsible for ensuring your content does not violate any laws or infringe on the rights of others. We reserve the right to remove content that violates these terms.

8. AI-Generated Content

Content generated by AI models may not always be accurate, appropriate, or suitable for your intended use. You are responsible for reviewing, editing, and ensuring the appropriateness of all AI-generated content before publishing or sharing.

We do not guarantee the accuracy, quality, or suitability of AI-generated content. You use AI-generated content at your own risk.

8.1 Image Generation Restrictions

Our image generation feature is designed exclusively for creating fictional story illustrations. To comply with our payment processor's policies and ensure responsible use, image generation is restricted as follows:

• Allowed: Scenery, locations, environments, objects, landscapes, buildings, interiors, and stylized illustrations for fictional narratives
• Prohibited: Human-like faces, realistic human portraits, close-up facial features, or any content that could be used to create human likenesses
• All image prompts are automatically filtered to prevent generation of human-like faces

Attempts to generate prohibited content will be automatically rejected. Repeated violations may result in account suspension or termination.

8.2 Prohibited Uses

You may not use this Service to generate:

• Human-like faces, realistic human portraits, or facial features
• Realistic human likenesses of real individuals
• Deepfakes, face swaps, or voice impersonations of real people
• Content intended to deceive, defame, or harm individuals
• Any content that violates applicable laws or third-party rights

This Service is designed for creating fictional stories and illustrative content for creative writing purposes only. Any use of the Service to create human-like representations is strictly prohibited and may result in immediate account termination.

9. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms, fraudulent activity, or any other reason we deem necessary. Upon termination, your access to the Service will be immediately revoked.

You may terminate your account at any time by contacting customer support. Upon termination, your content may be deleted after a reasonable grace period.

10. Limitation of Liability

To the maximum extent permitted by law, VisualStory AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

11. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated to users via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified terms.
